Clarence is a Counsel of Nair & Co. Prior to joining Nair & Co, Clarence held the helm as the Group General Counsel and Senior Legal Counsel of 2 major listed oil and gas companies in Singapore, having gained experience practicing in the dispute resolution department of an international law firm and a leading local law firm.

Clarence has extensive experience working on shipping, oil and gas, engineering, construction and infrastructure project disputes. In recent times, given his sectorial exposure to the offshore maritime industry, Clarence has actively been involved in oil and gas, offshore energy and maritime disputes.

Given Clarence’s in-house experience, Clarence has practical knowledge of the legal and commercial issues that in-house counsel and has also led and advised on contractual issues and negotiations relating to corporate transactions, regulatory work and front-end drafting of complex engineering and construction contracts.

Having graduated with a double degree in law and science (biological science), Clarence has a keen interest in medical negligence and has assisted the lead counsel in a leading reported case on medical negligence.



SIGNIFICANT MATTERS

  1. Involved in 6 ad-hoc arbitrations relating to offshore oil and gas disputes for total quantum in excess of USD $300million against an India national oil and gas company governed under Indian law governed in ad-hoc arbitration. Issues involved delay, defects, variation orders, change orders, FEED engineering designs, concurrent delay, liquidated damages.
  2. Involved in an offshore construction related claim of around USD 8 million against an Asian offshore services company. Singapore law governed in an SIAC arbitration in Singapore.
  3. Involved in an offshore construction related dispute governed under English Law of around USD 65 million against a leading European multi-national oil and gas company.
  4. Involved in an ICC arbitration relating to offshore construction related dispute governed under Mexico Law of around USD 14 million against a Houston based offshore services company operating in Mexico. Mexican law governed in negotiations in Houston.
  5. Involved in an SCMA arbitration relating to charter-party claim of around USD 4.5 million against an Asian offshore services company.
  6. Involved in resisting urgent application for multiple injunctions on the calling on multi-million-dollar performance bonds by an Asian multi-national oil and gas company. Indian law governed in the courts of India.
  7. Involved in the negotiation and drafting of various joint venture consortium agreements and front-end engineering and construction contracts with prominent oil and gas companies based in Indonesia, Malaysia and Belgium.
  8. Involved in a RM 30mil construction claim relating to a Malaysia conglomerate on purported unlawful termination of contract and dispute with joint venture partner.
  9. Involved in a USD 112mil shipbuilding building involving a Singapore listed company and Chinese shipbuilder involving issues relating to delay, defects, refund guarantee.
  10. Involved in a USD $170mil matter in relation to letters of support pledged by a controlling to support a listed company in relation to the purported debts arising from the sales and leaseback agreement. Issues involve whether the Letters are enforceable at law and the legal obligations that arise under the letters.
  11. Assisted lead counsel in acting for a patient in a leading reported case on medical negligence.
