Nair & Co’s Associate Director, Bryan Tan, speaks at SCCA Seminar on Creditors’ Rights When Assets are Dissipated in Bad Times

18 April 2018 – Nair & Co’s Associate Director, Bryan Tan, gave a talk entitled ‘Spirited Away – When the going gets tough and the assets get going’ held at The Co. @ Duxton, which was attended by in-house counsels and liquidators. Bryan spoke on creditors’ rights in the event that assets are dissipated by debtor companies in bad times. Bryan covered topics such as the law on clawbacks in insolvency, Director’s duties and liabilities to creditors, and measures creditors can take to protect their interests. The session ended with a case study of Living the Link Pte Ltd (in creditors’ voluntary liquidation) and others v Tan Lay Tin Tina and others [2016] SGHC 67.

The session was a lively one with questions from the audience on a broad range of topics such as third party funding, judicial management and the effectiveness of personal guarantees.

The event was capped off with post-event drinks at Praelum Wine & Bistro.
